PLEASE BE ADVISED that the application for a variance to increase the number of lots permitted to be accessed by private easement from three (3) to four (4) at 835 SW Hilary Street (docket VR 1-21) has been withdrawn and the public hearing regarding the variance or minor partition that was recently noticed is canceled.

Following staff and legal review of past land-use documents, it has been determined that legal access to a portion of the property at 835 SW Hilary Street via private access easement from SW Fellows Street has already been approved by the City via land-use approval, MP 7-00.  Therefore, no variance is required and the application has been withdrawn.  
 

Steve and Mary Allen, property owners, are requesting approval of a zoning variance (docket VR 1-21) to allow an increase in the number of lots permitted to be accessed by a private easement from three (3) to four (4), thereby providing access to a portion of the subject site.  The property owners are also requesting approval to partition an approximately 7.22 acre parcel of land into three (3) parcels, approximately 6.43, 0.31, and 0.48 acres in size to allow for residential development (docket MP 6-20).  The proposed 0.31 acre parcel would be accessed by private easement per variance request VR 1-21, while the 6.43 and 0.48 acre parcels would be accessed from SW Hilary Street.  The subject site is located at 835 SW Hilary Street and is more specifically described as Tax Lot 1600, Section 29AB, T.4 S., R.4 W., W.M.  The applications will be reviewed concurrently.
