If you were the victim in a recent matter that was filed with the McMinnville Municipal Court, here are answers to common questions.
HOW DO I RECEIVE PAYMENT FOR THE COST OF THE DAMAGES?
You may be eligible to receive restitution for some or all of your damages. In order for you to receive restitution from the party responsible for any damages caused by that person, you must submit a copy of the estimate(s) for repair of the damages or a bill to the court. Please provide the court with this information within two weeks. You may deliver this information by mail or in person at McMinnville City Hall, Municipal Court Department, 230 NE 2nd Street, McMinnville, OR 97128. For your convenience, you may phone the court at 503-434-7402 with the amount; however, you must follow up with a written copy of the actual damage estimates or bill. Please reference the case number and the name of the defendant whenever you communicate with the court and on any documents submitted so that we may track your case properly. Please be aware that your failure to report and document any damage may leave the court without an amount certain to order the defendant to pay, should the Judge require restitution as part of the sentence. It is always a matter of the Judge’s discretion as to whether there will be an order of restitution and the amount that is fair for the defendant to pay.
HOW DO I FOLLOW THE CASE TO KNOW WHAT IS HAPPENING?
You may also want to follow the case as it proceeds through the court system. At your request, the court staff will be glad to advise you of when the case is scheduled for the next court appearance. Please note, however, that it is never possible to say with certainty whether a defendant will appear at a scheduled time. Quite frequently court matters may be reset the morning of a scheduled appearance by either of the parties, or the attorneys, or by other necessity. Your understanding and patience with this last minute changing schedule will be greatly appreciated. Feel free to call the court at 503-434-7402 the day before the scheduled appearance to verify the matter has not been rescheduled. If you would like to make a victim’s impact statement to the court, you should indicate to the court staff upon your arrival to the courtroom that you wish to be heard by the Judge at the time of sentencing. A short statement will generally be heard, or you may send a letter if you do not wish to appear in person. While it is of great regret that this incident occurred, please be assured that the court will make every effort to properly administrate justice and continue to promote public safety and awareness in the City of McMinnville.
